Liability of Online Platforms and IP Rights Infringement

When online platforms host infringing content, who bears the risk – the platform or the user?

Platform liability for third-party intellectual property (IP) infringement is an important legal issue both globally and in Serbia. In the EU, platforms are subject to the Digital Services Act (DSA), which outlines detailed rules regarding platform obligations, responsibilities, and liability.

In Serbia, the legal framework is more fragmented, as there is no single regulation that systematically governs the area.  Detailed analysis of the challenges and how platforms balance protecting IP rights with safeguarding freedom of expression is provided by JPM Senior Associate Miloš Maksimović from Belgrade office.
