The Assembly of the Republic of Serbia enacted 4 laws in the field of mining and energy, including two new laws. – the Law on the Use of Renewable Energy Sources and the Law on Energy Efficiency and Rational Use of Energy, as well as amendments to two laws – the Law on Energy and the Law on Mining and geological research.
JPM Senior Partner Dr Jelena Gazivoda, with Partner Nikola Djordjević and Senior Associate Marko Mrđa, have prepared separate sets of information regarding the 4 laws, that we shall hereon share in a series of posts, starting with the Law on Utilization of Renewable Energy Sources (RES).
The aim of this new law is to enable new investments in RES and increase the share of renewable sources in total energy produced, as well as to ensure the protection of the environment and fight against climate change. The new law introduces market premiums instead of the current feed-in tariffs, in line with EU state aid rules and, it introduces a ban on the construction of hydropower plants of any type and power in protected areas. At the same time, it provides a stable and predictable legal framework for investors, which includes simpler and faster administrative procedures.
